Civil Harassment and violating constitutional rights.
So Springfield, MO Police Department is violating the Constitutional rights of civilians on park central square.
I watch from the library bar as a fat cop sits there all day stalking people during the day who aren't doing anything wrong. They are just sitting there. One lady was sitting there with a book in her hand and received a loitering ticket by fat officer stooly. And I'm using that stoolie word liberally. After the fat nasty cop with a dog from Police academy 2.
So far I have done some research and after speaking with my legal teams. We have discovered that this violates the first and 14th amendment of the United States Constitution.. as well as it is known as civil harassment. In case you're wondering what constitutional rights they're violating. The first amendment allows people to the right to peaceably assemble. And the 14th amendment is the right to Liberty.
Now civil harassment is when law enforcement agents abuse their privileges as sworn officers to harass people who aren't doing anything wrong.
I personally am holding the Springfield Police department accountable for this. And I'm calling them out on their illegal activity. They have meth heads dealing drugs in front of fast and friendly a mile and a half away from the square.. and they're down there stalking people and harassing people..
This needs to end..
They might be homeless but at the end of the day they have constitutional and civil rights just like the re
st of us.
What does the law say.
It is legal for the Springfield Police Department to enforce obstruction or conduct rules in public spaces during the day, but pure "loitering" laws face strict constitutional limits regarding whether simply standing in a public square is unlawful. Which it is not.
Legal Framework for Public Spaces
Constitutional Limits: Broad anti-loitering laws that criminalize simply standing or gathering in a public place without a specific unlawful intent are frequently struck down by courts as unconstitutionally vague or overbroad. So what these officers are doing is giving them camping tickets. Just because they have two bags next to them does not mean they're camping. They're just sitting there talking to each other. Yet these officers issue false tickets anyway.
Obstructing Passage: Police typically cannot ticket someone just for being in a public square during the day unless that person's specific conduct blocks pedestrian walkways, hinders free passage, or violates specific safety and conduct rules.
City Directives: Law enforcement must generally give a warning or an order to move along when behavior becomes unreasonably obstructive, violent or interferes with public property use before any citation or enforcement action occurs.
People are allowed to be in public squares during the day. The Constitution allows for the right to peaceably assemble which is found in article 1 of the United States Constitution. And the right to Liberty which is found in the 14th amendment of the United States Constitution.
All laws both municipal city-state and county must adhere to us constitutional and federal laws. It is illegal for a city or county to create a law that violates Federal and constitutional laws.
Public squares are considered public spaces open for general use, walking, and gathering during regular daytime hours.
And I want the Springfield Police department to know that when you violate people's constitutional rights and then violate the law in the form of civil harassment just to satisfy your ego. We will be there watching you every step of the way. You may not know it but Springfield Daily News has eyes everywhere.
You are being monitored you are being watched just because you are an officer of the law does not give you the right to break the law. You are not above the law. In fact local law enforcement are under the law more than civilians.
We will take you down if you continue. Let this be a warning.
Public servants must adhere to laws.
If you continue to break these laws we will be there to expose you to the media.
